WayNear Terms of Use

These Terms of Use apply to the WayNear mobile application. By using WayNear, you agree to these Terms. If you do not agree, do not use the app.

1. The service

WayNear helps users search for places near a current or selected location and compare them using walking time, distance, opening-status information, and related place data. Results are provided using third-party mapping and place-data services.

2. Location and search requests

If you choose to use your current location, WayNear may request foreground approximate or precise location access from Android and transmit the selected location to the services needed to perform the search. Location access is optional; you may instead type another place/address or choose a starting point on the map.

3. Google Maps Platform

WayNear uses Google Maps Platform / Places content and services. By using WayNear features that use Google Maps Platform, you agree to be bound by the Google Maps/Google Earth Additional Terms of Service. Google's handling of information is described in the Google Privacy Policy. The applicable Google Maps Platform terms may vary by region and billing location.

4. Other third-party services

WayNear may use other providers, including TomTom for custom place/address suggestions and Supabase for backend infrastructure. Third-party services and content remain subject to their own terms, policies, availability, and licensing conditions.

5. Accuracy and availability

Place names, addresses, opening hours, walking times, route distances, business status, and other information can be incomplete, delayed, or inaccurate. WayNear does not guarantee that a place is open, reachable, safe to access, or suitable for a particular purpose. Verify important information directly with the relevant place or authoritative source.

6. Not for emergency or safety-critical use

WayNear is not an emergency service, safety system, or turn-by-turn navigation service. Do not rely on it where an incorrect place, route, opening status, or travel-time estimate could create a safety risk.

7. Acceptable use

You must not use WayNear to violate law, interfere with the service, bypass technical or economic safeguards, abuse provider APIs, scrape or systematically extract provider content, or store/reuse provider content in a way that violates applicable provider terms.

8. Intellectual property and provider content

WayNear's application code, design, and original materials are protected by applicable intellectual-property law. Mapping, place, and route content may be owned or licensed by Google, TomTom, or other providers and is displayed under the applicable provider terms and attribution requirements.

9. Purchases and subscriptions

WayNear may offer an auto-renewing subscription and one-time in-app search packs through Google Play. The current price, billing period, renewal terms and product benefits shown in Google Play at the time of purchase are the authoritative purchase terms. An auto-renewing subscription renews until cancelled through Google Play. When an auto-renewing subscription is offered in a production release, the app will provide access to Google Play subscription management so users can manage or cancel it.

Google Play processes the payment transaction. Cancellation, refund, grace-period and other purchase handling are also subject to Google Play's applicable terms and mandatory consumer rights.

10. Changes and service availability

WayNear may change, suspend, or discontinue features as the product, provider APIs, platform rules, or legal requirements change. Reasonable efforts may be made to keep the service available, but uninterrupted availability is not guaranteed.

11. Liability and consumer rights

To the extent permitted by applicable law, WayNear is provided on an “as available” basis without guarantees beyond those that cannot legally be excluded. Nothing in these Terms limits mandatory rights or remedies that apply to you under consumer or other applicable law.

WayNear's handling of user and device data is described in the WayNear Privacy Policy.

13. Changes to these Terms

These Terms may be updated when the app, providers, or legal requirements change. The effective date above will be updated for material changes.
